SWIMMING POOLS AND SPAS

Public swimming pool or spas are defined as any swimming pool or spa operated by a person as owner, licensee, lessee or concessionaire, whether or not a fee is charged, and does not include swimming pools or spas located on private property used for swimming, bathing, or other recreational activities only by the homeowner, members of the homeowner’s family, or their invited guests; or medicinal hot water bathes for individual use (50-53-101, MCA).

Public swimming pools and bathing places are required to be licensed under 50-53-201, MCA and license fees are established under 50-53-203, MCA and cost $75 per year.

The Dawson County Sanitarian inspects swimming pools and spas for compliance with Title 16, Chapter 10, Subchapter 10, ARM. Seasonal pools and spas are inspected on an annual basis, while year-round pools and spas are inspected semi-annually.

Whenever a swimming pool or spa is constructed, remodeled, or altered, plans and specifications shall be submitted to the Food & Consumer Safety Section of the Montana Department of Public Health & Human Services for review and approval.
