Dawson County Open Burning Regulations and Policy

Authority

Effective July 1, 1992 the Dawson County Commissioners, through a written contract, assigned County wide fire protection responsibilities to the West Glendive Fire District Board of Trustees including the regulation of open burning.

Open Burning Defined

"Open Burning" means, combustion of any material directly into the open air with exception of small recreational fires.

Effective Date

The following regulations will become effective July 1, 1992 and remain in effect until amended or canceled by the West Glendive Fire District Board of Trustees.

No Person shall cause, suffer, allow or permit an open fire within Dawson County excluding the City of Glendive and the Town of Richey except when written permission for such fire is obtained in advance.

Annually, anyone wishing to open burn in Dawson County must contact the Sanitarian's Office (207 West Bell/377-5772) Monday-Friday 8:00 am to 5:00 pm and sign and receive a copy of the permit and the "Dawson County Open Burning Regulations and Policy"

One a permittee has signed a burn permit application and been given a copy of the regulations, their requirement for the remainder of the calendar year will be to call the Glendive Police Department (GPD 377-2364) to notify the GPD of the location and when they actually plan to start the fire.  The fire does not have to be out by nightfall!

Liability

Persons burning without a permit or not conforming to burning regulations will be liable for all fire suppression costs and all damages resulting from such burning.

Prohibited Open Burning

The West Glendive Fire District Board of Trustees hereby adopts and incorporates by reference 40 Code of Federal Regulations (CFR) Part 261, which identifies and defines hazardous wastes.  The following material may not be disposed of by open burning:

  1. Any waste which is moved from the premises where it was generated, including waste moved to a solid waste disposal site
  2. Food wastes
  3. Styrofoam and other plastics
  4. Wastes generating noxious odors
  5. Poultry litter
  6. Animal droppings
  7. Dead animals or dead animal parts
  8. Tires
  9. Rubber materials
  10. Asphalt shingles
  11. Tar paper
  12. Automobile bodies and interiors
  13. Insulated wire
  14. Treated lumber and timbers.
  15. Pathogenic wastes.
  16. Hazardous wastes as defined by 40 CFR Part 261
  17. Any materials resulting from a salvage operation.

Fire Control

It is the responsibility of all applicants to provide adequate fire suppression equipment to contain all open burning to the area/location and materials as specified in the application for permit.

Burning Restrictions

Open burning may be curtailed at any time as ordered by the Dawson County Fire Warden when it is determined to be in the best interest of the public.  Severity of conditions will determine whether all burning will be curtailed or whether only non-essential burning will be curtailed.
